A2: Amounts apportioned on this line are available for obligation provided that DOW, with respect to new shipbuilding programs, contract modifications in excess of $100 million, and the exercise of options within existing contracts or block-buy agreements: (1) submits to OMB notice at least five business days in advance of any initial outreach to potential contractors for any sole source, multiyear, multi-ship, or block buy contract award funded with amounts apportioned on this line; (2) submits to OMB copies of any requests for proposals that will lead to any sole source, multiyear, multi-ship, or block buy contract award funded with amounts apportioned on this line at least ten business days prior to issuance; and (3) submits to OMB, prior to awarding a new shipbuilding contract: (a) Its business case used to justify the contract type and cost; (b) The specific contract terms to limit the cost growth on contract; (c) Confirmation that the contract is within the amounts appropriated for the contract, to include government furnished equipment: and (d) If applicable, a plan to OMB to secure anticipated funding shortfalls for the contract, to include a prior approval reprogramming requesting the execution year funds from within existing Navy resources.
