A1: A classified attachment displaying the apportionment of specific classified programs within the amount displayed may be included. All documents associated with this apportionment are unclassified except for the Classified Attachment. The classified apportionment shall be allotted in full and executed without change. Such apportionment shall remain valid during the fiscal year until such time as a reapportionment of such classified apportionment is required. Allotments shall be made no later than 30 days after OMB signs the apportionment or the start of the subsequent calendar month, whichever is later. A3: Amounts apportioned on this line are available for obligation provided that, from the date of this apportionment, DOW complies with the clearance requirements of section 22.3 and 22.4 of OMB Circular A-11 for all matters concerning shipbuilding, including matters concerning rescission or reappropriation of such appropriated amounts, and applies the same clearance requirements to all official materials for public release concerning shipbuilding procurement actions, including requests for information or proposals, modifications, commitments, awards, and Navy force structure changes. If OMB determines that DOW has failed to comply with such sections 22.3 or 22.4 or the clearance requirements related to public release referenced above, OMB will notify DOW in writing and DOW must seek reapportionment prior to further obligation of such amounts as of the date of such notice. A5: Unless a shorter timeframe is otherwise provided by OMB in writing, amounts apportioned on this line are available for obligation provided that DOW, with respect to new shipbuilding programs, contract modifications in excess of $100 million, and the exercise of options within existing contracts or block-buy agreements: (1) submits to OMB notice at least five business days in advance of any initial outreach to potential contractors for any sole source, multiyear, multi-ship, or block buy contract award funded with amounts apportioned on this line; (2) submits to OMB copies of any requests for proposals that will lead to any sole source, multiyear, multi-ship, or block buy contract award funded with amounts apportioned on this line at least ten business days prior to issuance; and (3) submits to OMB, prior to awarding a new shipbuilding contract: (a) Its business case used to justify the contract type and cost; (b) The specific contract terms to limit the cost growth on contract; (c) Confirmation that the contract is within the amounts appropriated for the contract, to include government furnished equipment: and (d) If applicable, a plan to OMB to secure anticipated funding shortfalls for the contract, to include a prior approval reprogramming requesting the execution year funds from within existing Navy resources.
