A2: To the extent authorized by law, this amount is apportioned for the current fiscal year. Apportioned amounts may be adjusted upwards without further action by OMB by up to 2 percent of total budgetary resources to reflect non-expenditure transfers of budget authority or balances authorized by law. [Rationale: Footnote signifies that this TAFS has received or may receive an automatic apportionment.]

A3: Amounts apportioned on this line are available for obligation 15 business days after the 400 Years of African American History Commission (Commission) submits to OMB a spend plan that includes: anticipated obligations for projects and programs, by project or program, supplemented with a detailed description of how each project aligns with Administration priorities as well as an organizational chart and staffing plan. Until that time, the Commission may obligate funds only as necessary for Federal salary and payroll expenses, minimum expenses to maintain safe operations, or payments otherwise required by law. [Rationale: An agency spend plan or other document is necessary to better understand how the agency intends to obligate some or all of the apportioned funds.]
