A8: With the exception of spending authority from offsetting collections, amounts apportioned, but not yet obligated as of the date of this reapportionment, on this line for Wild Horse and Burro Management are available for obligation consistent with the latest agreed-upon spend plan for Fiscal Year 2026 between the Department of the Interior (DOI) and the Office of Management and Budget (OMB). Such spend plan submitted by DOI for Wild Horse and Burro Management shall include: the existing and anticipated obligations of such amounts by spending category (e.g., salaries and expenses, training and technical assistance, cooperative agreements, grant funding, etc.) a detailed description of how such spending plan aligns with Appropriate Management Levels (AMLs) in accordance with the Wild and Free-Roaming Horses and Burros Act of 1971 (P.L. 92-195); and a detailed discussion of how increased flexibility in the transfer of these animals would change the trajectory of on-range horse and burro populations. Any revisions or additions to such spend plan shall be proposed to OMB in writing no later than five business days before the anticipated obligation of funds based on such revisions or additions. If OMB agrees to such revision or addition, OMB will notify DOI in writing, and the latest agreed-upon spend plan shall include that modification. In the absence of an agreed-upon spend plan between DOI and OMB, DOI may obligate funds for Wild Horses and Burro Management only as necessary for Federal salary and payroll expenses, emergency gathers, or payments otherwise required by law.
